BillPath, LLC ("BillPath," "we," "us," or "our") provides software that helps general contractors, subcontractors, suppliers, and architects manage AIA-style pay applications, lien waivers, and related construction billing documents (the "Service"). This policy explains what information we collect, how we use it, and the choices you have.

Information we collect

Account information. When you or your company create an account, we collect your name, email address, and company/organization details through our authentication provider, Clerk.

Project and billing data. Information you enter into the Service — project details, schedules of values, pay application line items, change orders, daily logs, subcontractor payment records, and lien waiver information — is stored so the Service can function. This data is entered by you or by your organization and may include information about other parties to a construction project (for example, a subcontractor's company name or a supplier's contact information).

Usage and log data. We automatically collect certain technical information when you use the Service, such as IP address, browser type, device information, and pages visited, to help us operate and secure the Service.

Cookies. We use cookies and similar technologies for core site functionality (like keeping you signed in) and, with your consent, for analytics. See "Cookies and tracking" below.

How we use your information

We use the information we collect to:

• Provide, maintain, and improve the Service;
• Generate pay applications, lien waivers, and related documents you request;
• Send account, billing, and waiver-related notifications and reminders;
• Detect, prevent, and address fraud, abuse, or security issues; and
• Comply with legal obligations.

Cookies and tracking

We use necessary cookies to operate the Service and, only with your consent, cookies for analytics and marketing. You can accept, reject, or customize these choices at any time from the "Cookie preferences" link in the footer of this site.

How we share information

We do not sell your personal information. We share information only with:

• Service providers who host and operate the Service on our behalf, including Clerk (authentication), Supabase (database hosting), Vercel (application hosting), and Resend (transactional email delivery);
• Other parties on your construction project when you use the Service to share pay applications, waivers, or billing information with them — this is the core function of the Service;
• Legal or safety reasons, if required by law, subpoena, or to protect the rights, property, or safety of BillPath, our users, or others; and
• A successor entity in connection with a merger, acquisition, or sale of assets.

Data retention

We retain account and project data for as long as your account is active or as needed to provide the Service, and afterward for as long as required to meet legal, accounting, or recordkeeping obligations (which, for construction billing and lien waiver records, can be several years under applicable state law).

Data security

We use reasonable technical and organizational measures, including encryption in transit, access controls, and role-based permissions, to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your privacy rights

Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, and to object to or restrict certain processing. California residents have additional rights under the California Consumer Privacy Act (CCPA/CPRA), described on our Do Not Sell or Share My Personal Information page. Children's privacy

The Service is intended for business use by adults and is not directed to children under 16. We do not knowingly collect personal information from children.

Changes to this policy

We may update this policy from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly.
